Welcome to ChristianWebSpace Web Hosting Solutions! This Web Hosting Agreement
governs your purchase and use, in any manner, of all Web site hosting services,
including the Dedicated and Virtual Hosting Services, (for the purpose of this
agreement, termed "Web Services") as described in the Order Form. BY CLICKING ON THE "I
ACCEPT THE TERMS" BUTTON , AND REGISTERING FOR AND USING THE SERVICES, YOU
ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY THE TERMS
AND CONDITIONS CONTAINED HEREIN. ChristianWebSpace reserves the right to change or modify any of
the terms and conditions contained in this Agreement, from time to time
in its sole discretion. Any changes or modifications to the agreement will be
effective upon posting of the revisions on the ChristianWebSpace Web site.
1. 30 Day Guarantee
30 Day Guarantee. If you are not fully satisfied with the a Virtual Hosting Package, you may terminate this Agreement at any time during the first thirty (30) days from your initial order date and receive a full refund of all payments made by you to ChristianWebSpace for the Virtual Hosting Package. To receive such refund, you must terminate this Agreement by sending an email to billing@ChristianWebSpace.com, cease using the Services, and ChristianWebSpace must receive your termination notice, within the above described thirty (30) day period. You agree to provide ChristianWebSpace with a description of why you are not satisfied with the Services and are terminating this Agreement. See 'Use of Web Services', note 2.3 concerning Free Domain Names.
2. Use of Web Services
2.1 Software Requirements. You must ensure that all material and data placed on ChristianWebSpace's equipment is in a condition that is "server-ready," which is in a form requiring no additional manipulation by ChristianWebSpace. In the event that your material is not "server-ready", ChristianWebSpace has the option at any time to reject this material. ChristianWebSpace will notify you of its refusal of the material and afford you the opportunity to amend or modify the material to satisfy the needs and/or requirements of Topclassohst. Use of the Services requires a certain level of knowledge in the use of Internet languages, protocols and software. This level of knowledge varies depending on the anticipated use and desired content of your Web site. You must have the necessary knowledge to create and maintain a Web site. It is not ChristianWebSpace's responsibility to provide this knowledge or customer support outside of the Services agreed to by you and ChristianWebSpace.
2.2 Bandwidth allowance, Disk Storage, and E-Mail Usage. You agree that use of the Services hereunder will not exceed the bandwidth, storage and E-mail usage limits set out in the Order Form. If you use any bandwidth or storage space in excess of the agreed upon number of megabytes per month or if you exceed E-Mail storage and attachment size limitations, ChristianWebSpace may, in its sole discretion, assess you with additional charges, suspend the performance of the Service, or terminate this Agreement
2.3 Domain Names. As part of the Web Services, you will provide ChristianWebSpace with a registered domain name or names or ChristianWebSpace will register such domain name(s) selected by you, provided that such domain name is available for registration and does not violate any 'Network Solutions' policies. In the event you purchased a package with a "Free Domain Name Registration" offer when you signed up for the Services, and you terminate the Services within one year of such domain name registration, you agree to immediately pay ChristianWebSpace the full retail price for the domain name registration.
3. Limitation and Exclusion of Liability
3.1 Limitations. IN NO EVENT SHALL ChristianWebSpace HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF INFORMATION DISTRIBUTED OR MADE AVAILABLE FOR DISTRIBUTION VIA THE SERVICES THROUGH ACCIDENT, FRAUDULENT MEANS OR DEVICES.
3.2 Interruption of Service. You hereby acknowledge and agree that ChristianWebSpace will not be liable for any temporary delay, outages or interruptions of the Services. Further, ChristianWebSpace shall not be liable for any delay or failure to perform its obligations under this Agreement, where such delay or failure results from any act of God or other cause beyond its reasonable control (including, without limitation, any mechanical, electronic, communications or third-party supplier failure).
4. Indemnification You hereby release and hold harmless, and agree to indemnify, ChristianWebSpace against any and all claims, actions, proceedings, suits, liabilities, damages, settlements, penalties, fines, costs or expenses (including, without limitation, reasonable attorneys' fees and other litigation expenses) incurred by ChristianWebSpace, arising out of or relating to your violation or breach of any term, condition, representation or warranty of this Agreement, or your improper or illegal use the Services; or your violation, alleged violation, or misappropriation of any intellectual property right (including, without limitation, trademark, copyright, patent, trade secrets) or non-proprietary right of a third party (including, without limitation, defamation, libel, violation of privacy or publicity).
5. Prohibited Uses. You
acknowledge and agree not to use, nor permit the use of or by any person, to transmit any obscene communications with intent to annoy another
person or persons or to any person under 18 years of age, in violation of
any patent, trademark, service mark, or copyright law, or to transmit
unsolicited advertisements of services or solutions, a practice also known as
"spamming" or mail relay "spamming".
BY ORDERING A SOLUTION FROM ChristianWebSpace YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY IT.
